Online Cook LLC, together with its parents, subsidiaries and affiliates (the “Company”, “OnlineCook”, “we”, “us” or “our”), is committed to protecting your (“you”, “your” or “user”) privacy and empowering you with this privacy policy (this “Privacy Policy”).
This Privacy Policy explains how we collect, use, disclose, and apply the information collected when you access, use, or interact with our website, located at www.onlinecook.com (the “Website”), the OnlineCook mobile application (the “App”, and collectively with the Website, the “Platform”), and the various services, offerings, content, functionality, and features made available by us (collectively, the “Services”).
Our User Terms of Service and Creator Terms of Service located on our platform (collectively, the “Terms”) are expressly incorporated herein, by reference, and are an integral part hereof.
This Privacy Policy sets forth our policy with respect to information that we collect from you, on or through the Services, that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“Personal Data” or “Personal Information”). We take the privacy of your Personal Data seriously. Because of that, we have created and abide by this Privacy Policy. By using the Services or interacting with us, you are agreeing to the application of this Privacy Policy. Please read the following carefully to understand how we collect, use, disclose, and maintain information that can be used to identify you. In addition, this Privacy Policy describes your choices for use, access, and correction of your Personal Data. If you do not agree to be bound by this Privacy Policy, please stop accessing or using the Services.

You may choose to submit information to us when you use our Services, create an account via the Services, in connection with an actual or potential business relationship with us, or when interacting with us. More information about the categories and sources of Personal Data is provided below.
Information You Provided to UsWe collect Personal Data that you decide to share with us. At times, we may require you to provide certain information in order to use certain parts of our Services, fulfill your requests, or provide you with certain services.
- Account Information If you establish an account with us, we may require you to provide your name, physical address e-mail, payment information, password. You may also provide us with any other information which you choose to upload to your account or your profile (if you are a “creator”).
- Payment Information If you purchase any of our Services, we will collect your credit card information (e.g., your credit card number and expiration date, billing address, etc.). All credit card information is stored by Stripe, or another similar third-party payment processor selected by us, from time to time, and such payment services are governed by Stripe or such third-party payment processor’s terms of service and privacy policy. For the avoidance of doubt, your credit card information is never stored by the Company or on the Company’s servers. If you are a “creator”, who is participating in OnlineCook’s Creator Program, and with respect to receiving your creator commissions, you will provide directly Stripe, or another similar third-party payment processor selected by us from time to time, your bank account information or your payment information associated with any other available creator commission payout method offered from time to time. As such, if you are a “creator”, (i) we will not be the party collecting or receiving your bank account information or your payment information associated with any other available creator commission payout method, (ii) the payout services are therefore governed by Stripe or such third-party payment processor’s terms of service and privacy policy, and (iii) for the avoidance of doubt, your credit card information is never stored by the Company or on the Company’s servers
- User and Creator Content Certain features and functionalities on the Services may allow you to send, transmit, upload, post, publish, broadcast, or share certain user or creator generated content. We may gather Personal Data from the content, reviews, posts, photos/images, videos, and other information and text that you send, transmit, upload, post, publish, broadcast, or share on the Services.
- Social Media Data We have pages on social media services like Facebook, Twitter, Instagram, and LinkedIn (“Social Media Pages”). When you interact with our Social Media Pages, we will collect Personal Data that you elect to provide to us, such as your contact details and messages sent. In addition, the companies that host our Social Media Pages may provide us with aggregate information and analytics regarding the use of our Social Media Pages.
- Contacting Us You may interact with us through our Services, including through any interactive feature, online contact form, email, or any other communication mechanism. When using these channels, you typically provide your account information and any other information you choose to provide at your option
- Surveys We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information which may include Personal Data.
We may obtain Personal Data about you from third-parties who help us provide our Services. We may also obtain some information from our marketing partners in order to inform you about products or services that we think you might be interested in. Finally, we may obtain information that does not identify you directly, but which is later used in a way that may directly identify you. We may combine that general information with your Personal Data to provide related services to you
Information We Automatically CollectWe automatically collect certain information from you when you use the Services, including internet or other network activity information (as described below), unique device identifiers, browsing and search history (including content you have viewed in the Services), and cookies and other technologies (as described below). Information collected automatically includes:
- Log information We retain information about you when you access and use the Services. This information can include, e.g., the following: Internet Protocol (“IP”) address, timestamps, browser information, internet service provider, webpages visited, and the URL of the webpage you visited before navigating to our Services.
- Usage Information We monitor user activity in connection with the Services and may collect information about the features you use within the Services as well as the types and amount of the Services you use.
- Crash and Error Information If the Services crash or return an error, we may collect data to determine the cause of the error using first or third-party services. The crash or error information collected may include, e.g., the following: device IP address, device name, operating system version, application configurations(s), the time and date, and other statistics.
If you use our App, we also may collect the following information if you choose to provide us with access or permission. This information is primarily needed to maintain the security and operation of our App for troubleshooting and for our internal analytics and reporting purposes
- Geolocation Information We may request access or permission to track location-based information from your mobile device, either continuously or while you are using our App, to provide certain location-based services. If you wish to change our access or permissions, you may do so in your device's settings.
- Mobile Device Data We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, and device and application identification numbers. We may also collect information about the phone network associated with your mobile device, your mobile device’s operating system or platform, the type of mobile device you use, your mobile device’s unique device ID, and information about the features of our App that you accessed.
- Push Notifications We may request to send you push notifications regarding your account or certain features of the App. If you wish to opt out from receiving these types of communications, you may turn them off in your device&apso;s settings.
4. Cookies and Other Technologies
Our Services may use cookies and other technologies (such as “pixel tags”, “web beacons”, “clear GIFs”, links in e-mails, JavaScript, device IDs assigned by Google or Apple, or similar technologies) to collect information and support certain features of our Services. Cookies and other technologies allow us and third-parties to obtain information about your visits to our Website and use of our Services, including analyzing your visiting patterns. For example, we may use Plausible, from time to time, to collect information to improve the Services, such as how often users visit the Services, what pages they visit when they do so, and what other websites they used prior to visiting the Services. Although you are not required to accept cookies when you visit our Website, you may be unable to use all of the functionality of our Services if your browser restricts our cookies. We use this information to process your requests and to deliver online and mobile advertisements, messages, and content for us and others that are specific to your interests. The information we collect from cookies and other technologies does not identify you personally but in some cases, we may link it to your Personal Data.

- Necessary Cookies These cookies are essential for you to browse our Website and to access and use our Services, as well as for us to identify and prevent security risks, and contain information about a user’s authentication status on the Website and the Services. Without these cookies, certain Services, like logging into secure areas within the Services, cannot be provided
- Performance Cookies These cookies collect information about how you use our Website and the Services, such as which pages you visit most often. This information is used to improve how our Website and the Services work.
- Functionality Cookies These cookies allow our Website and the Services to remember choices you make (such as your username, language, or the region you are in) and to provide you with enhanced, more personalized features.
- Marketing/Advertising Cookies If employed by us, from time to time, marketing cookies are used to show users display advertisements across websites; however, we do not display ads for any website/company besides our own.
In addition to cookies, we may use other technologies to, among other things, track the actions of the users of the Services, measure the success of our marketing campaigns, and compile statistics of the Services.
5. How We Use Your Information
We may use the Personal Data that we collect for our legitimate interests and the limited purpose of providing the Services and as permitted by applicable law. These purposes include circumstances where it is necessary to provide or fulfill the Services requested by or for you or where you have given us your express consent. As such, we may use your Personal Data to:
- Provide the information, products, and services you request;
- Service your account and provide you, if you are a registered user or creator, with effective customer service;
- Better understand your needs and interests, and provide you with a personalized experience when you use our Services;
- Contact you with special offers and other information we believe will be of interest to you (in accordance with any privacy preferences you have expressed to us);
- Contact you with information that you have requested and notices related to your use of our Services;
- Send you commercial or marketing/advertising messages, including, without limitation, newsletters, text messages and e-mail communications about our offerings or Services;
- Invite you to participate in surveys and provide feedback to us (in accordance with any privacy preferences you have expressed to us);
- Improve our Services and offerings, develop new Services and offerings, improve our marketing and promotional efforts, and improve the content, functionality, and usability of the Services;
- Enforce our other policies, such as our Terms;
- Promote security and protect against and prevent fraud, claims, and other liabilities;
- Verify the information that you provide to us as well as the representations and warranties that you make to us in the Terms or on the Services;
- Meet our internal and external audit obligations; and
- To comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third-parties.
In some cases, we will ask you for consent to use your Personal Data for specific purposes. If we do, we will make sure that you can revoke your consent in in accordance with the “Your Choices” section below.
Other PurposesIf we intend to use any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to, or at the time that, the Personal Data is collected, or we will obtain your consent subsequent to such collection, but prior to such use.
Aggregated Personal DataWe may aggregate and/or de-identify information collected through the Services and from other sources so that such information can no longer be linked to you or your device (“Aggregate/De-Identified Information”). We may use Aggregate/De-Identified Information for any purpose, including, without limitation, for research and marketing purposes.
6. How We Share and Disclose Information
We do not sell or otherwise disclose Personal Data we collect about you, except as described herein or otherwise disclosed to you at the time such Personal Data is collected.
Service ProvidersWe provide access to or share your Personal Data with select third-parties who perform services on our behalf. Pursuant to our instructions, these third-parties will access, process, or store Personal Data in the course of performing their duties to us. We take commercially reasonable steps to ensure that our service providers adhere to the security standards we apply to your Personal Data. Our service providers provide a variety of services to us, including, for example, billing, accounting, sales, marketing, advertising, analytics, research, affiliate marketing, customer relationship management, customer service, data storage, security, fraud prevention, payment processing, and legal services
Public ForumsCertain features of our Services make it possible for you to share user or creator generated content, reviews, photos/images, videos, and other information and text that you send, transmit, upload, post, publish, broadcast, or share on the Services. Any information that you submit through such features is not confidential, and we may use it for any purpose (including in testimonials or other marketing materials). Any information that you post openly in these ways will be available to the public at large. Accordingly, please take care when using these features
Your ConsentWe may ask for your consent to share your Personal Data with certain third parties. When we do, we will make it clear why we want to share the information. We may share your information for other purposes pursuant to your consent or with your further direction.
SettingsWe may share information consistent with your settings selections within the Services.
Aggregate/De-Identified DataFrom time to time, we may share Aggregate/De-Identified Information about use of the Services, such as by publishing a report on usage trends. The sharing of such data is unrestricted.
Legal ReasonsWe may also disclose your Personal Data when we, in good faith, believe disclosure is appropriate to comply with the law, a court order, or a subpoena. We may also disclose your Personal Data, e.g., to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of our Services; to enforce or apply our policies or other agreements; or to protect our own rights or property or the rights, property or safety of our users or others. We will attempt to notify our users about legal demands for their Personal Data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague, or lack proper authority
Sale, Merger, or Other Business TransferAs we continue to develop our business, we may buy, merge, or partner with other companies. In such transactions (including in contemplation of such transactions), Personal Data may be among the transferred assets. If a portion or all of our assets are sold or transferred to a third-party, your Personal Data would likely be one of the transferred business assets. If such transfer is subject to additional mandatory restrictions under applicable laws, we will comply with such restrictions

Please note that despite any indicated e-mail marketing preferences, we may continue to send you administrative e-mails regarding the Company and the Services, including, for example, notices of updates to our policies or this Privacy Policy if we choose to provide such notices to you in this manner. Additionally, you have a choice, at any time, to stop us from sending you text messages by responding to such text with the appropriate opt-out text phrase
- If you do not provide the information that we need to provide the Services, we may not be able to provide with the Services or certain functionalities. We will tell you what Personal Data that you must provide in order to use the Services and related functionalities or services.
- Some browsers offer a “do not track” (“DNT”) option. Since no common industry or legal standard for DNT has been adopted by industry groups, technology companies, or regulators, we do not respond to DNT signals. We will make reasonable efforts to continue to monitor developments around DNT browser technology and the implementation of a standard

If you are a resident of the State of California, you may have certain rights afforded to you under the California Consumer Privacy Act or the “CCPA”, as amended by the California Privacy Rights Act.
We collect Personal Information for the business and commercial purposes described in the section above titled “How We Use Your Information”, and we share Personal Information with the categories of third-parties described in the section above titled “How We Share and Disclose Information”. We do not ‘sell’ (as such term is defined in the CCPA) the Personal Information we collect (and will not sell it without providing you a right to opt-out). Please note that we do use third-party Cookies for our advertising purposes as further described in the section above titled “Information We Automatically Collect”.
California law, if applicable to us, provides some California residents with the rights listed below:
- You may have the right to request that we disclose to you the Personal Information we collect, use, or disclose, and information about our data practices.
- You may have the right to request that we delete your Personal Information that we have collected from you.
- You may have the right to request that we correct your inaccurate Personal Information.
- You may have the right to exercise control over our collection and processing of certain sensitive Personal Information.
- You have the right not to receive retaliatory or discriminatory treatment for exercising these rights.

Under the CCPA, you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf. We may request that your authorized agent have written permission from you to make requests on your behalf and may need to verify your authorized agent’s identity.
Additional Information for Colorado Residents (Effective July 1, 2023)The Colorado Privacy Act, if applicable to us, provides some Colorado residents with the rights listed below:
- You may have the right to know and see what Personal Data we have collected about you in a portable format.
- You may have the right to request that we correct your inaccurate Personal Data.
- You may have the right to request that we delete the Personal Data we have collected about you.

Addition Information for Nevada Residents (Effective October 1, 2019).If you are a Nevada resident, under Privacy and Security of Personal Information Chapter of the Nevada Revised Statutes Section 603A, we are required to provide you with the following:
- We may collect certain covered information (as defined under Nevada Law) when you use or visit our Services, including, but not limited to first and last name, home or other physical address, e-mail address, and telephone number;
- We may share your covered information to third-parties as described in the section above titled “How We Share and Disclose Information”; and

Please note that to respond to some rights we may need to verify your request either by asking you to log in and authenticate your account or otherwise verify your identity by providing information about yourself or your account. You may designate another person to serve as your authorized agent and to act on your behalf to opt-out of the processing of your Personal Data under specifically Section 7.5.2(vi); however, we may request certain information in order to verify your identity and the authorized agent’s authority to act on your behalf.
Additional information for Texas Residents (Effective July 1, 2024)If you are a Texas resident, pursuant to the Texas Data and Privacy Security Act, we must share with you that:

9. European Residents
If you are a resident of the European Economic Area, we rely on our legitimate interest as described in this Privacy Policy to process your Personal Data. Additionally, subject to any exemptions as provided by law, you may have certain rights regarding the Personal Data we maintain about you. We offer you certain choices about what Personal Data we collect from you, how we use that information, and how we communicate with you. If, at any time, you wish to exercise your rights, please reach out to us in accordance with the “Contact Us” section below.
Right of AccessIf you ask us, we will confirm whether we are processing your Personal Data and, if so, provide you with a copy of that Personal Data along with certain other details. If you require additional copies, we may need to charge a reasonable fee.
Right to RectificationIf your Personal Data is inaccurate or incomplete, you are entitled to ask that we correct or complete it
Right to ErasureYou may ask us to erase your Personal Data in some circumstances, such as where we no longer need it or you withdraw your consent (where applicable) and there is no other legal basis for processing.
